First Offense of Driving Under the Influence
You may feel a first DUI conviction is not that big of a deal but it really is. First of all it is considered a criminal conviction and you will have a “Criminal Record” that can never be expunged. If you are convicted you can be sentenced to serve up to 90 days in jail depending on your blood alcohol test results. Further, you can be ordered to pay a fine of up to about $2,000. Then to make matters worse, your driving license will be suspended for a period of 6 months. And even after the suspension period, you will not get your license reinstated unless you enroll in the required Alcohol and Drug Safety Action Program also called ADSAP. The cost of ADSAP will range from $500 up to $2,500. And of course, you will be required to get special high liability insurance called SR-22 Insurance which is very expensive and you must keep it for 3 years or your license will be revoked again.
The penalties for subsequent offenses increase and get harsher. Click here to review penalties for subsequent offenses.
Remember just because you were arrested for a DUI, and even if you blew above the legal limit, does NOT mean you will be found guilty of a DUI.
